End User License Agreement

1. License grant
Subject to your compliance with this End User License Agreement (“EULA”), TradeCutgrants you a personal, non-exclusive, non-transferable, revocable license to install and use the TradeCut desktop application for macOS or Windows (the “App”) on computers you own or control, for your own use.
2. Restrictions
Except where such a restriction is prohibited by law, you may not reverse-engineer, decompile, disassemble, redistribute, resell, sublicense, or remove or obscure any proprietary notices from the App.
3. Ownership
The App is licensed, not sold. TradeCut and its licensors retain all right, title, and interest in and to the App, including all intellectual property rights. This EULA does not grant you any rights to TradeCut’s trademarks or branding.
4. Automatic updates
The App updates itself automatically to deliver bug fixes, security patches, and new features. By installing and using the App, you consent to receiving these automatic updates.
5. Third-party & open-source components
The App bundles third-party and open-source components — including ffmpeg and other open-source libraries — each used in accordance with its respective license. Those licenses govern your use of the corresponding components in addition to this EULA.
6. Termination
This license is effective until terminated. It terminates automatically if you breach any term of this EULA. Upon termination, you must stop using the App and, if requested, remove it from your device.
7. Disclaimer of warranties
The App is provided “as is” and “as available,” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. TradeCut does not warrant that the App will be uninterrupted, timely, secure, or error-free.
8. Limitation of liability
To the maximum extent permitted by law, TradeCut will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the App, even if advised of the possibility of such damages.
9. Governing law
This EULA is governed by the laws of the jurisdiction in which TradeCut is established, without regard to its conflict-of-law principles. Any dispute arising from this EULA or the App will be subject to the exclusive jurisdiction of the courts of the jurisdiction in which TradeCut is established.
